Will my settlement or jury award be taxed?

In most cases, when an attorney with our Arlington firm secures a settlement or jury award for a client, the money is not taxed. There are some exceptions. For example, punitive damages (money awarded as a means of punishing a defendant for gross negligence) can be taxed. Your attorney will be able to identify any other circumstances that might result in your compensation being taxed.

I might be partially responsible for the accident. Does that mean I don't have a case?

No! Texas operates under the principle of modified comparative negligence. In other words, if you are less than 51 percent at fault, you can collect damages. For example, if a jury determines that you were 30 percent at fault, you could still collect up to 70% of your losses from the other party. It can never be emphasized enough: if you think you are partially responsible for the accident, don't tell anyone other than your car accident lawyer. An insurance company would love to use your own words against you to make it sound like you are more responsible than you are. Your attorney may find that you share no responsibility. Never draw your own conclusions, and only discuss your case with your lawyer.

The other driver was charged with DUI. Should I still file a personal injury claim?

Yes. DUI is a crime that will involve its own trial. Although a judge in a criminal hearing may award damages to you in extreme cases, you still need to file a civil suit to claim damages for your losses.
