Changing Lawyers
Do You Want to Change Attorneys?
The Basics of Changing Lawyers in Texas
In Texas, you have the right to change lawyers at any time for any reason. You could even change lawyers for no reason at all. However, if your attorney has not violated the contract and you do not have good cause for termination, then under Texas law your attorney has certain rights to his fee. Before you terminate your attorney, we strongly recommend that you meet personally with them and try to find a solution.
You may be unhappy about your representation due to an honest misunderstanding. It could be that your attorney is willing to make certain changes in the way they are handling your case or dealing with you. If you and your attorney are still unable to work things out to your reasonable satisfaction, it may be time to hire a new attorney.
You Can Change Attorneys Without Taking on Additional Fees
We often take over the prosecution of a claim when a client realizes they would rather have the Law Firm of Roger 'Rocky' Walton, P.C. fighting their case. We are almost always able to reach a friendly agreement with the initial attorney on a split of the fee so that it will not cost the client any additional money. If no agreement can be worked out, our Arlington team can advise you on how to get help from the Tarrant County Fee Arbitration Committee.

Rocky is happy to discuss your case and your desire to change counsel. There are two key first steps he takes for clients who want to change lawyers.
During a free consultation at his Arlington, TX, office he will evaluate your case. This allows him to understand its legal merits and determine if your case is right for our law firm.
The other major action Rocky takes for clients seeking a new lawyer is to provide a second opinion on any issues at hand. Rocky's decades in practice give him an intimate understanding of the client-lawyer relationship, and he may be able to advise you about how to repair the situation with your current legal representative.
Second Opinions Are Within Your Rights We Offer Them for Free
In Texas, you have the right to seek a second opinion. It is not necessary for you to terminate your present attorney to seek a second opinion and you do not have to get your attorney's consent. For example, if your attorney is recommending that you accept a settlement that you strongly feel is too low, it may be wise to talk to Rocky so you can understand if the value of your claim is higher than the offer you are being advised to accept.
Some Texas clients think that because their lawyer is trained and knowledgeable, their recommendation to accept a settlement must be right. However, it is important for you to understand that in some cases, a lawyer may have ulterior motives for wanting a swift settlement. They might not have the resources or confidence to take your case to trial. Another possibility is that they could have significant overhead costs, or personal financial reasons for needing money now.
Receive Rocky's Second Opinion
If you would like for us to give you a free second opinion, just call. We will discuss the claim with you generally, understand where you are at in your case, and assess the value of your claim. Talking to our Arlington, TX, team can give you perspective on your current counsel's behavior, and allow you to ask legal questions regarding their work.
If we think an existing settlement offer may be unreasonably low, we will make an appointment to meet with you to begin our evaluation. It only takes a few days for our attorneys to reach a second opinion after we have the information we need. There is no cost or obligation to you.

We Understand the Client Is Boss
At our firm, we never forget who is boss. We know that we are working to achieve our clients' goals within the law. On matters of strategy and negotiations, it is our job to give advice and honest recommendations. However, the client ultimately makes the final decisions.
When our client tells us to accept an offer or go forward with the case, we feel obligated to follow our client's instructions as long as they are making informed decisions. However, we will not follow our client's instructions if the act or omission would be illegal, unethical, or violate The Texas Lawyer's Creed.
